Welcome to Harisch Hotel GmbH. To provide a clear basis for our services, the following terms and conditions apply to your stay.
1. Scope and Contracting Parties

Contracting Party: The contract is concluded between Harisch Hotel GmbH and the person placing the order (the “Ordering Party”). This applies even if the order is placed for or on behalf of other named persons.

Guests: Individuals making use of the accommodation are considered “guests” within the meaning of these terms.

Room Photos: Images shown on our website are examples of the respective category. Layout, design, and amenities may vary in individual cases.
2. Conclusion of Contract and Payment

Conclusion: The contract becomes binding once we have confirmed your reservation and received the agreed deposit. There is no statutory right of withdrawal from the accommodation contract.

Deposit & Prepayment: We reserve the right to request a deposit or the prepayment of the total agreed amount. If payment is not made on time, we reserve the right to rent the rooms to others (this is considered a cancellation by the guest).

Age Restriction: Please note that children under the age of 16 are not permitted in the sauna area.
3. Arrival and Departure (Check-in / Check-out)

Check-in: Your room will be available from 3:00 PM on the agreed day of arrival.

Late Arrival: If you plan to arrive after 6:00 PM, please inform us. If no deposit has been made and no notification is received, we reserve the right to reassign the room after 6:00 PM. If a deposit has been paid, the reservation remains valid until 12:00 PM the following day.

Early Arrival: If a room is occupied before 10:00 AM, the previous night will be charged as the first overnight stay.

Check-out: On the day of departure, guests must vacate the room by 11:00 AM. Failure to vacate the room by this time entitles the hotel to charge for an additional day.
4. Cancellation and Rebooking
Unless other cancellation terms have been specifically agreed upon, the following applies:

Up to 29 days before arrival: Cancellation is free of charge (applies specifically to Harisch Suites Kitzbühel and special dates such as Christmas and New Year’s Eve).

28 to 8 days before arrival: A cancellation fee of 70% of the total arrangement price will be charged.

7 days or less before arrival / No-show: A cancellation fee of 100% of the total arrangement price will be charged.

Unused Services: The obligation to pay remains even if the guest does not utilize the booked rooms/services or if the reason for travel no longer exists (e.g., cancellation of the Hahnenkamm ski race). However, we will deduct any revenue obtained from re-renting the rooms.

Rebooking: Changing the travel date within the same calendar month is possible for a rebooking fee of EUR 100.00.
5. Provision of Alternative Accommodation
The hotel may provide the guest with adequate alternative accommodation if this is reasonable for the guest—specifically if the difference is minor and objectively justified. Objective justification includes rooms becoming unusable, current guests extending their stay, or other significant operational requirements. Any additional costs for the alternative accommodation will be covered by the hotel.
6. Rights and Obligations of the Guest

Right of Use: By concluding the contract, the guest acquires the right to the standard use of the rented rooms and the facilities of the hotel that are usually accessible to guests without special conditions.

Payment: The agreed fee must be paid upon termination of the accommodation contract. The hotel is not obliged to accept non-cash means of payment (checks, credit cards, vouchers) unless previously agreed. Any costs associated with these payment methods are to be borne by the guest.

Outside Food and Drinks: Consuming food or beverages brought from outside in public hotel areas entitles the hotel to charge a reasonable fee (e.g., “corkage fee” for drinks).

Electrical Appliances: The use of electrical devices brought by the guest that do not belong to standard travel requirements requires the hotel’s consent.
7. Liability

Damage by Guest: The guest is liable for any damage or disadvantage caused to the hotel or third parties by their own fault or the fault of their companions/visitors.

Hotel Liability: The hotel is liable for damages suffered by a guest if the damage occurred within the operation and was caused by the fault of the hotel or its employees.

Items Brought into the Hotel: We are liable for items brought in by guests up to a maximum amount of EUR 1,100.00. For valuables, cash, and securities, liability is limited to EUR 550.00, unless these items were specifically taken into custody with knowledge of their nature.
8. Termination of Accommodation

Early Departure: If the guest leaves prematurely, the hotel is entitled to charge the full agreed amount (minus any revenue from re-renting the rooms).

Termination by Hotel: We are entitled to terminate the contract with immediate effect if a guest makes significantly detrimental use of the premises, behaves in a grossly improper manner toward other guests or staff, contracts a contagious disease, or fails to pay the invoice upon request within a reasonable period.

Force Majeure: If the fulfillment of the contract becomes impossible due to an event of force majeure, the contract is dissolved. Any payments already received will be refunded proportionally.
9. Illness or Death of a Guest
If a guest falls ill or passes away during their stay, the hotel will provide necessary medical care if the guest is unable to do so. The hotel is entitled to compensation from the guest (or their legal successor) for costs including medical fees, room disinfection, replacement of unusable linens, and room rent for any period the room remains unusable (minimum 3, maximum 7 days).
10. Place of Performance and Jurisdiction

The place of performance is the location where the hotel is situated.

For all disputes arising from the accommodation contract, the court with subject-matter and local jurisdiction at the hotel’s location is agreed upon.
